These Terms & Conditions apply to Atlas Guard LLC ("we", "us", or "our"), a software-only SaaS provider. For questions, contact contact@atlasguard.io.

01Service Description

Atlas Guard LLC provides a software-only SaaS platform for system analytics, performance data, and reporting intended for authorized business and organizational use.

Atlas Guard is purely a read-only reporting interface. The platform displays customer-provided system data only. It does not access, control, scan, execute transactions, move funds, or interact with customer infrastructure in any way. Atlas Guard has zero access to customer systems, servers, networks, or databases. All data displayed in the platform is voluntarily transmitted by customers through API keys or webhook endpoints they configure.

Customers connect systems through API keys or webhook endpoints they configure within their Atlas Guard dashboard.

Platform access provides reporting and analytics tools only, not outcomes.

02Delivery of Services (Digital Fulfillment)

All services are delivered digitally through the Atlas Guard platform. After successful payment, access is provisioned through the customer dashboard. No physical products are shipped. No physical goods are involved. Delivery is considered complete when platform access is provisioned.

03Account Responsibility

Users must provide accurate information, maintain account security, and notify us of unauthorized access. Customers are solely responsible for their own infrastructure, configurations, and operational decisions.

04Acceptable Use

Atlas Guard may only be used to observe systems that the customer legally owns or has explicit written authorization to manage. Customers must have legal ownership or written permission for all connected infrastructure.

Atlas Guard does not facilitate unauthorized access to third-party systems and reserves the right to verify organizational authorization upon request.

Misuse of the platform may result in immediate account termination.

Prohibited uses include but are not limited to: using the platform for any illegal or unauthorized purpose, attempting to reverse engineer or decompile any part of the platform, reselling or sublicensing access without written permission, using the platform to transmit malicious code or interfere with platform integrity, and impersonating another user or organization.

05Billing & Subscription Terms

Subscriptions are billed in advance and renew automatically unless canceled. Canceling stops future billing. Access remains active through the current billing period.

Atlas Guard subscriptions provide access to software functionality and platform usage rights only. Payments are for digital SaaS access, not for guaranteed outcomes, results, or deliverables. Customers may request a refund within 14 days of purchase in accordance with the Atlas Guard Refund Policy.

06Payment Processing

Payments are securely processed by PCI-DSS compliant third-party providers. Atlas Guard does not store, process, or handle credit card information directly. Atlas Guard acts solely as a software provider and does not function as a financial institution, payment processor, money transmitter, or intermediary of any kind.

07Security Practices

We follow industry-standard security practices intended to protect platform integrity and customer data. However, Atlas Guard is a software-only provider and does not control customer environments, networks, or infrastructure. Customers remain solely responsible for their own system security posture, configurations, and operational decisions.

08Compliance & Industry Controls

Atlas Guard provides reporting tools that help organizations track operational data for their internal compliance processes.

09Intellectual Property

All platform content and software are owned by Atlas Guard LLC. Users may not reproduce, alter, or distribute without permission.

10Limitations of Liability

We are not liable for indirect or consequential damages. To the maximum extent permitted by law, total liability is limited to the amount paid by the customer for services during the three (3) months preceding the claim.

11Governing Law

These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in North Carolina.

12Business Use Only

Atlas Guard is designed for internal business analytics and operational teams. Services are intended exclusively for business and organizational use (B2B). Consumer use is not supported. By using the platform, you represent that you are acting on behalf of a business entity.

13Compliance Disclaimer

Atlas Guard provides software tools only. It does not guarantee specific security, compliance, or operational outcomes.

14Platform Operation Model

All data displayed in the platform is transmitted voluntarily by customers from systems they manage. Atlas Guard only stores data that customers intentionally send to the platform. Customers connect systems through API keys or webhook endpoints they configure within their Atlas Guard dashboard.

15Termination

Either party may terminate this agreement at any time. Customers may cancel their subscription through the platform dashboard. Atlas Guard reserves the right to suspend or terminate access immediately for violations of these Terms, non-payment, or misuse of the platform. Upon termination, customer data will be retained for 90 days to allow for data export, account transitions, and standard business continuity requirements. After the 90-day period has elapsed and all applicable legal and regulatory retention obligations have been satisfied, data will be permanently deleted and cannot be recovered. Sections relating to intellectual property, limitations of liability, and governing law survive termination.

16Dispute Resolution

Before initiating formal legal proceedings, both parties agree to attempt resolution through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in North Carolina under the rules of the American Arbitration Association, except where prohibited by law.

17Changes to Terms

Atlas Guard reserves the right to update these Terms at any time. We will notify users of material changes via email or a notice on the platform. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
